Fisher v. NCNB National Bank

District Court of Appeal of Florida, Fourth District
Jun 15, 1988
526 So. 2d 222 (Fla. Dist. Ct. App. 1988)

Opinion

No. 87-3061.

June 15, 1988.

Appeal from the Circuit Court for Broward County; Miette K. Burnstein, Judge.

Eugene Lewis, Sunrise, for appellant.

Frank J. Sinagra of Haley, Sinagra Perez, P.A., Fort Lauderdale, for appellee.

We reverse. The trial court erred in granting NCNB National Bank's motion to dismiss. Fisher's complaint alleges sufficient facts to state a cause of action in negligence. See Stahl v. Metropolitan Dade County, 438 So.2d 14, 17 (Fla. 3d DCA 1983).

REVERSED AND REMANDED.

ANSTEAD, GLICKSTEIN and GUNTHER, JJ., concur.
