BY ORDER OF THE COURT.

The petition for writ of prohibition is denied without prejudice. See Sumner v. Sumner, 707 So.2d 934 (Fla. 2d DCA 1998). To the extent petitioner requests that this court treat the petition as a petition for writ of certiorari, we lack jurisdiction to do so. See Parkway Bank v. Fort Myers Armature Works, Inc., 658 So.2d 646, 648–49 (Fla. 2d DCA 1995).

Respondent's motion to dismiss petition as moot is denied as moot.
