Conditional upon the filing of the original promissory note with the clerk of the Superior Court, that portion of the judgment awarding damages for principal and interest on the note is affirmed. So much of the judgment imposing a maturity penalty and awarding attorney's fees and costs is vacated, and the case is remanded to the Superior Court for an evidentiary hearing on those issues. Neither party is to have costs of appeal.
