Order directing trial at Special Term affirmed, with ten dollars costs and disbursements. The complaint, and for that matter the answer as well, demands equitable relief. The only items of money damage involved are the amount of the deposit, which is admitted, and the cost of searching the title, which may be disposed of by the court as well as by a jury. Kelly, P.J., Rich, Manning, Young and Lazansky, JJ., concur.
