We REINSTATE this appeal.
We abated this appeal for the trial court to make findings concerning the court reporter's not having filed State's exhibit 1, the interview with the defendant, and State's exhibit 1A, a redacted version of the interview with the defendant. The court reporter has now filed State's exhibits 1 and 1B. Review of volume 6, page 124, of the reporter's record indicates that State's exhibit 1B is "the fully redacted version of the interview." It therefore appears that State's exhibit 1B was substituted for State's exhibit 1A.
Accordingly, we VACATE that portion of our orders of August 24, 2023, and August 28, 2023, that required the trial court to hold a hearing and make findings concerning State's exhibits 1 and 1A. The trial court need not hold the hearing or make the findings.
The record is complete. Appellant's brief is due on or before November 8, 2023.
We DIRECT the Clerk to send copies of this order to the Honorable Benjamin N. Smith, Presiding Judge, 380th Judicial District Court; Karla Kimbrell, Official Court Reporter for the 380th Judicial District Court; and counsel for all parties.
