ORDER OF DISMISSAL


The only defendant remaining in this lawsuit is Mitchell Brown. According to a status report filed by the plaintiff, Brown filed a bankruptcy petition on January 30, 2003. On May 6, 2003, Brown was discharged in bankruptcy. The plaintiff did not object and has advised the Court that as a result of that discharge nothing remains pending before this Court. Accordingly, this action is hereby DISMISSED.

IT IS SO ORDERED.
