Pursuant to the Court's October 5, 2023, Order petitioner filed an unopposed Motion to Appoint Tax Matters Partner. By Order issued on November 14, 2023, the Court granted petitioner's Motion to Appoint Tax Matters Partner and amended the caption of the case.
In light of the foregoing, it is
ORDERED that respondent shall, on or before January 8, 2024, move to withdraw his Motion to Dismiss for Lack of Jurisdiction, filed March 16, 2022, or in the alternative, file a supplement to the Motion.
