On order of the Court, the motion for immediate consideration is considered, and it is GRANTED, as to both the application and the motion to terminate the stay.

The delayed application for leave to appeal from the July 24, 1998 decision of the Court of Appeals also is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

The motion to terminate the stay is DENIED as moot.
