Kristi Farley v. Girish Mangalick MD

LC No. 20-002584-NO

Kirsten Frank Kelly Presiding Judge Thomas C. Cameron Noah P. Hood Judges.

ORDER

Kirsten Frank Kelly Presiding Judge.

The motion for immediate consideration is GRANTED.

The motion to waive the transcript-production requirements under MCR 7.205(B)(4) is DENIED as moot. For future reference, we note that the filing of such motions is generally unnecessary, even in emergent situations. See MCR 7.205(B)(4) ("If the transcript is not yet available, or if there is no record to be transcribed, the appellant must file a copy of the certificate of the court reporter or recorder or a statement by the appellant's attorney as provided in MCR 7.204(C)(2) . As soon as the transcript is available, the appellant must file it with the Court of Appeals.") (emphasis added).

The application for leave to appeal is DENIED for failure to persuade the Court of the need for immediate appellate review.
