Fareri v. Fareri

Appellate Division of the Supreme Court of New York, Second Department
Dec 27, 1949
276 App. Div. 872 (N.Y. App. Div. 1949)

Opinion

December 27, 1949.

In an action to annul a marriage on the ground of fraud, defendant appeals from an interlocutory judgment annulling the marriage between the parties. Interlocutory judgment reversed on the law and the facts, without costs, and a new trial granted. In our opinion the trial court's findings are against the weight of the evidence. Nolan, P.J., Carswell, Johnston, Sneed and MacCrate, JJ., concur.
