Supreme Court of Florida
Aug 30, 2021
No. SC21-790 (Fla. Aug. 30, 2021)

Opinion

SC21-790

08-30-2021

MATTHEW L. FAISON Petitioner(s) v. CHAIRMAN & CHAIRWOMAN OF BLACKWATER BAND, ET AL. Respondent(s)

Lower Tribunal No(s).: 1D20-1890; 172018CA000808XXXXXX

The petitioner has filed a petition to invoke all writs jurisdiction. To the extent the petitioner seeks to invoke the Court's all writs jurisdiction, the petition is dismissed for lack of jurisdiction because the petitioner has failed to cite an independent basis that would allow the Court to exercise its all writs authority and no such basis is apparent on the face of the petition. See Williams v. State, 913 So.2d 541, 543-44 (Fla. 2005); St. Paul Title Ins. Corp. v. Davis, 392 So.2d 1304, 1305 (Fla. 1980). To the extent the petitioner seeks mandamus relief against the First District Court of Appeal, the petition is hereby dismissed as moot. Any motions or other requests for relief are also denied.

The Court hereby retains jurisdiction to pursue any possible sanctions. See Fla. R. App. P. 9.410(a) (Sanctions; Court's Motion). Petitioner is hereby directed to show cause on or before September 14, 2021, why, pursuant to section 944.279(1), Florida Statutes (2020), a certified copy of the Court's findings should not be forwarded to the appropriate institution for disciplinary procedures pursuant to the rules of the Florida Department of Corrections as provided in section 944.09, Florida Statutes (2020).

POLSTON, LABARGA, LAWSON, COURIEL, and GROSSHANS, JJ., concur.
