The court contemplates taking judicial notice under Evidence Code section 452, subdivision (d) of: (1) the underlying grand jury transcripts and (2) the public superior court docket in each case. The parties are directed to serve and file, by Thursday, February 8, 2018, letter briefs addressing “the propriety of taking judicial notice of each matter and . . . the tenor of the matter to be noticed.” (Evid. Code, §§ 455, subd. (a); 459, subd. (c).)
The motion filed by providers on November 3, 2017, asking this court to take judicial notice of Facebook, Inc., v. Superior Court (Touchstone) (2017) 15 Cal.App.5th 729 (S245203, rev. granted Jan. 17, 2018), is granted.
