Appeal and Error.

Where, after certified copy of notice of appeal was filed in Supreme Court, no further steps were taken and no brief was filed in behalf of the appellant, appeal would be deemed abandoned and order appealed from would be affirmed.

Appeal from Circuit Court, Grant County; HON.W.W. KNIGHT, Judge.

Proceeding by the State, on the relation of Edward J. Conrad, against Franz Wendland, wherein Mose S. Lindau intervened.

From an adverse order, defendant appeals.

Affirmed.

Certified copy of notice of appeal was filed in this court on January 17, 1938. Since that time no further steps have been taken in this court, and no brief has been filed in behalf of the appellant. The appeal is therefore deemed abandoned, and the order appealed from is affirmed.
