On August 9, 2023, this court issued an opinion and judgment reversing the trial court's order and remanding this case to the trial court for further proceedings. The State then filed a motion for rehearing, which this court denied on September 12, 2023.
On its own motion, the en banc court has voted to reconsider this appeal en banc. See Tex. R. App. P. 19.1(b); 49.5. This appeal remains pending before the en banc court.
