ORDER

Lori I. Valenzuela, Justice.

On August 25, 2023, Appellant, Gregorio Mendez-Avendano, filed "Appellant's Emergency Motion for Stay of Trial Court Proceedings." In the motion, Appellant requests an order staying all proceedings in the trial court related to this case.

Because Appellant's motion states that this case was set for an in-person pretrial hearing on September 5, 2023, and for trial on September 11, 2023, we ordered Appellant to file an advisory with this court detailing whether his motion was moot. On September 29, 2023, in response to this court's order, Appellant filed a status report stating that the trial court had vacated the previous settings and had set the underlying case for docket call on November 6, 2023, and for trial on November 13, 2023, and that the motion is therefore not moot.

After considering Appellant's motion and status report, we GRANT the motion. We ORDER all trial court proceedings in Kinney County Cause No. 13978CR stayed pending final disposition of this appeal.
