On August 17, 2023, appellant Juan Maya Jimenez filed a notice of appeal appealing the trial court's order denying his application for pretrial writ of habeas corpus. In his habeas proceeding, appellant brought a selective prosecution equal protection claim arguing that the policy of arresting men, and not women, for criminal trespass violates his constitutional rights under the federal and state constitutions.
On August 22, 2023, appellant filed a motion requesting a stay of trial court proceedings in the underlying case pending resolution of this appeal. Appellant represents that the next proceeding in this case is scheduled for September 5, 2023, and that the trial court requires appellant's in-person presence for this hearing. We therefore treat appellant's motion as an emergency motion and GRANT appellant's motion and ORDER all trial court proceedings in Kinney County Cause No. 14118CR stayed pending disposition of this appeal or further order of this court. See Tex.R.App.P. 10.3(a)(3).
