EX PARTE Ramiro Cordova GARCIA

From the County Court, Kinney County, Texas Trial Court No. 14132CR Honorable Susan D. Reed, Judge Presiding

ORDER

Lori I. Valenzuela, Justice.

Appellant's brief originally was due on May 24, 2023. On May 16, 2023, appellant filed a motion to extend time to file his brief. Because the clerk's record did not contain a signed certification of appellant's right to appeal, we held the motion in abeyance pending further order of this court. A supplemental clerk's record containing the certification was filed on June 8, 2023. Accordingly, on June 12, 2023, we granted appellant's motion for an extension of time and ordered appellant to file his brief no later than July 12, 2023. Neither the brief nor a motion requesting an extension of time has been filed.

Appellant is represented by appointed counsel, Ms. Kristin Maria Etter, on appeal. Ms. Etter is hereby ORDERED to either (1) file appellant's brief no later than August 7, 2023 or (2) respond to this court in writing no later than August 7, 2023 stating a reasonable explanation for failing to timely file the brief and demonstrate the steps being taken to remedy the deficiency. If Ms. Etter fails to file either the brief or an adequate response by August 7, 2023, this appeal will be abated to the trial court for an abandonment hearing, and the trial court will be asked to consider whether sanctions are appropriate. Tex.R.App.P. 38.8(b)(2).
