EX PARTE Jimmy Coung DUC TRAN

From the 186th Judicial District Court, Bexar County, Texas
Trial Court No. 2019CR12300A
Honorable Jefferson Moore, Judge Presiding

ORDER

On July 9, 2020, appellant filed a motion to dismiss this appeal pursuant to Texas Rule of Appellate Procedure 42.2(a). Although Rule 42.2(a) requires the signatures of both appellant and his counsel, the motion states appellant's counsel was unable to obtain appellant's signature "due to the current COVID-19 pandemic." Given the serious consequences of the relief sought and the importance of demonstrating appellant's consent to the motion, the motion is DENIED, without prejudice to refiling, for failure to comply with Rule 42.2(a)'s signature requirement.

/s/_________

Sandee Bryan Marion, Chief Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 23rd day of July, 2020.

/s/_________

MICHAEL A. CRUZ, Clerk of Court
