Opinion Delivered April 27, 2011. DO NOT PUBLISH.

On Appeal from the 221st District Court, Montgomery County, Texas, Trial Cause No. 10-08-09318 CR.

Before McKEITHEN, C.J., KREGER and HORTON, JJ.

MEMORANDUM OPINION

James Steven Corley appealed after the trial court refused to grant relief on Corley's pre-trial petition for writ of habeas corpus seeking bond reduction. Corley filed his brief on March 10, 2011. The State has moved to dismiss this appeal as moot. Appellant has not filed a response. Appellant has been convicted of the underlying offense and is no longer subject to pre-trial confinement. Therefore, his petition for writ of habeas corpus is moot. See Martinez v. State, 826 S.W.2d 620 (Tex. Crim. App. 1992). Accordingly, the appeal is dismissed as moot. APPEAL DISMISSED.
