PER CURIAM
On August 8, 2023, the State of Texas filed a Motion to Abate Proceedings. After consideration, the State's motion is DENIED.
The State's brief is now due. We ORDER the State to file its brief by September 1, 2023. We advise the State that if the brief is not filed, the case may be set at issue without an appellee's brief.
The State's August 15, 2023 Motion for Extension and Re-Urging Motion to Abate Proceedings is DENIED AS MOOT.
