ABATEMENT ORDER

PER CURIAM

This is an appeal from the denial of an application for writ of habeas corpus arising from an arrest pursuant to Operation Lone Star. A petition for discretionary review is pending in the Court of Criminal Appeals in a similar Operation Lone Star habeas corpus appeal. See Ex parte Aparicio, No. 04-22-00623-CR, 2023 WL 4095939 (Tex. App.-San Antonio 2023, pet. filed). Accordingly, we will abate this appeal until the Court of Criminal Appeals resolves the pending petition for discretionary review in Aparicio.

The appeal is abated, treated as a closed case, and removed from this Court's active docket. The appeal will be reinstated on this Court's active docket when the Court of Criminal Appeals has disposed of the petition for discretionary review in PD-0461-23, Ex parte Aparicio. The Court will also consider an appropriate motion to reinstate the appeal filed by either party, or the Court may reinstate the appeal on its own motion.
