ORDER

Rebeca C. Martinez, Chief Justice.

On August 8, 2023, the State of Texas, filed a motion to abate proceedings. The State's motion is DENIED.

The State's brief was originally due on June 6, 2023. We extended the deadline three times to its current deadline of August 11, 2023, but, to date, the brief has not been filed. We ORDER the deadline for the State to file its brief extended until September 1, 2023. No further extension of time will be allowed absent extraordinary circumstances.
