524 So. 2d 1175 (Fla. Dist. Ct. App. 1988)

Opinion

Nos. 87-0619, 87-0620.

May 25, 1988.

Consolidated appeals from the Department of Professional Regulation, Board of Accountancy.

Russell L. Forkey and Pamela M. Burdick of Russell L. Forkey, P.A., Fort Lauderdale, for appellant-Etue.

Michael Sean Shannon of Michael Sean Shannon, P.A., Fort Lauderdale, for appellant-Wardlaw.

Lisa S. Nelson of Dept. of Professional Regulation, Tallahassee, for appellee.

We affirm the final administrative order of the State Board of Accountancy except that we find the Board acted contrary to statutory directives in imposing an additional two years probation on appellant James Etue. We remand with directions that the final order be amended and the two year probation period be deleted. The fine recommended by the hearing officer may be reinstated by the Board, in the Board's discretion.

ANSTEAD, GLICKSTEIN and GUNTHER, JJ., concur.
