ORDER

The motion to dismiss is GRANTED. The parties' stipulated order of May 13, 2021 expressly set aside the February 10, 2021 order that defendant sought to appeal. If, as here, there is no relief that this Court can grant on appeal, the appeal is moot. Can IV Packard Square LLC v Packard Square LLC, 328 Mich.App. 656, 666; 939 N.W.2d 454 (2019).

The delayed application for leave to appeal thus is DISMISSED AS MOOT.
