On August 25, 2023, respondent filed a Motion for Leave to File Out of Time Response to our Order issued June 26, 2023, directing respondent to file a report on or before July 10, 2023, and attach thereto a copy of the notice of deficiency on which this case is based. Respondent lodged with his Motion for Leave a Response to our June 26, 2023, Order (Response to Order) and attached thereto a copy of the above-referenced notice of deficiency.
By Order issued August 28, 2023, the Court extended the time period for respondent to comply with our June 26, 2023, Order to September 15, 2023.
Upon due consideration and for cause, it is
ORDERED that the Court's Order, issued August 28, 2023, is hereby vacated and set aside. It is further
ORDERED that respondent's above-referenced Motion for Leave is granted. It is further
ORDERED that the Clerk of the Court shall file the above-referenced Response to Order as of the date of service of this Order.
