ORDER

The motion for immediate consideration is GRANTED.

Pursuant to MCR 7.205(E)(2), in lieu of granting the application for leave to appeal, the Court REMANDS the case for the trial court to add a provision to the June 28, 2022 protective order that restricts plaintiffs use of the documents and tangible evidence subject to the protective order other than as required to determine whether or not defendant was engaged in phone or website activity on the morning of the crash. This provision must be included in the protective order for the protective order to strictly comply with the Court's mandate in Estate of Matthew Colvin v Lawson, unpublished order of the Court of Appeals, entered February 16, 2022 (Docket No. 359346), and Estate of Matthew Colvin v Lawson, unpublished order of the Court of Appeals, entered February 16, 2022 (Docket No. 359771). Rodriguez v Gen Motors Corp (On Remand), 204 Mich.App. 509, 514; 516 N.W.2d 105 (1994).

In all other respects the application is DENIED for failure to persuade the Court of the need for immediate appellate review.

This order is to have immediate effect. MCR 7.215(F)(2).

We do not retain jurisdiction.
