Eplee v. Eplee

District Court of Appeal of Florida, First District
Dec 22, 2000
773 So. 2d 658 (Fla. Dist. Ct. App. 2000)

Opinion

No. 1D00-1567.

Opinion filed December 22, 2000.

An appeal from the Circuit Court for Alachua County, Martha Ann Lott, Judge.

Bill Salmon, Gainesville, for Appellant.

Cynthia Stump Swanson of Swanson, Sperling and Clayton, Gainesville, and Joye M. Clayton, Gainesville, for Appellee.

Having considered the appellant's response to the Court's order issued June 12, 2000, the Court has determined that the order on appeal is neither a final order, nor a non-final order appealable pursuant to Florida Rule of Appellate Procedure 9.130. Accordingly, the appeal is dismissed for lack of jurisdiction. The dismissal is without prejudice to the appellant to file a separate notice of appeal when the trial court enters a final order.

Ervin, Booth, and Kahn, JJ., Concur.
