Opinion

No. 2D13–4441.

2013-11-22

Robert ELWELL, Appellant/Petitioner(s), v. STATE of Florida, Appellee/Respondent(s).

BY ORDER OF THE COURT.

This appeal, case number 2D13–4441, is dismissed for lack of jurisdiction because the circuit court orders under review are at this point of time nonappealable orders rendered during the still pending prosecution of appellant on criminal charges.

Also, it appears that counsel was appointed for appellant in circuit court case number 13–CF–7782 prior to the filing of any of the motions disposed of by the circuit court orders for which judicial review has been sought. The circuit court treated these motions as nullities. See Logan v. State, 846 So.2d 472 (Fla.2003); Harris v. State, 818 So.2d 567 (Fla. 2d DCA 2002).
