This case is currently calendared for the remote trial session of the Court on June 8, 2023, for cases where Charleston, West Virginia is the place of trial. Pending before the Court in this case is respondent's Motion for Summary Judgment, filed April 24, 2023 and petitioner's Motion for Continuance, filed May 8, 2023. On May 19, 2023, petitioner filed her opposition to respondent's Motion for Summary Judgment and on May 22, 2023, respondent filed their response to petitioner's Motion for Continuance. After due consideration of the representations in petitioner's motion and respondent's response, it is

ORDERED that petitioner's Motion for Continuance, filed May 8, 2023, is granted, and this case is stricken from the Court's June 8, 2023 remote trial session for cases where Charleston, West Virginia is the place of trial, and continued. It is further

ORDERED that respondent's Motion for Summary Judgment, filed May 19, 2023, is taken under advisement. It is further

ORDERED that jurisdiction is retained by this Division of the Court.
