LIDIA ELIZARDI A/K/A LIDIA E. MARTINEZ, Appellant, v. SOUTHWEST CONSTRUCTION AND RICHARD GUERRA, Appellees.

On appeal from the 404th District Court of Cameron County, Texas.

MEMORANDUM OPINION

Before Chief Justice Contreras and Justices Hinojosa and Tijerina
Memorandum Opinion by Justice Hinojosa

On March 27, 2020, appellant filed her notice of appeal. On March 30, 2020, the Clerk of this Court notified appellant that it appeared there was no final, appealable order in this matter so that steps could be taken to correct the defect, if it could be done. Appellant was further advised if the defect was not cured within thirty days from the date of receipt of this notice, the appeal would be dismissed. See TEX. R. APP. P. 42.3(a), (c).

Furthermore, on April 23, 2020, the Clerk of the Court notified appellant that she was delinquent in remitting a $205.00 filing fee. The appellant was further instructed that the appeal was subject to dismissal if the filing fee was not paid within ten days from the date of receipt of this letter. See id. R. 42.3(b), (c).

Appellant has failed to respond to the Court's notices and failed to pay the filing fee. Accordingly, the appeal is DISMISSED FOR WANT OF PROSECUTION. See id. R. 42.3.

LETICIA HINOJOSA

Justice Delivered and filed on the 28th day of January, 2021.
