This case was tried on June 7, 2023, at the Trial Session of the Court in Boston, Massachusetts. Jurisdiction of this case was retained at that time, and Simultaneous Opening Briefs were ordered to be filed on or before July 24, 2023.

On July 24, 2023, Petitioner filed with the Court an Assented to Motion for Continuance. Petitioner informed the Court that Petitioner and Intervenor have reached a basis of settlement and asked that this case be continued. Upon the Court's review, it appeared as though Petitioner is requesting an extension of time in which to file an opening brief. For that reason, the Court will recharacterize the Assented to Motion for Continuance as a Motion for Extension of Time to File Briefs.

Upon due consideration, and for cause, it is

ORDERED that Petitioner's Assented to Motion for Continuance at Index No. 71, filed with the Court on July 24, 2023, is recharacterized as Petitioner's Motion for Extension of Time to File Briefs. It is further

ORDERED that Petitioner's Motion for Extension of Time to File Briefs, filed with the Court on July 24, 2023, is granted. It is further

ORDERED that, on or before September 6, 2023, the parties shall file with the Court their Simultaneous Opening Briefs or decision documents.
