Gen. No. 41,453. (Abstract of Decision.)

Opinion filed December 23, 1940 Rehearing denied January 6, 1941

TRIAL, § 191verdict forms, waiver of defects. In action for injuries sustained by butcher shop patron when she fell in entranceway leading to store, wherein lessor and person conducting the butcher shop were joined as defendants, although verdict forms should not only have provided for a finding of guilty or not guilty, but should also have permitted different findings as to the two defendants, still where counsel for defendant asked for such other forms but plaintiff's counsel objected on ground it was a joint suit, plaintiff could not later ask for new trial on ground such other verdict forms should have been given.
