Jenna Earl v. Martin J. O'Malley

Present: The Honorable: R. Gary Klausner, United States District Court Judge

CIVIL MINUTES - GENERAL

Proceedings (In Chambers): Order To Show Cause Re: Venue

On July 11, 2024, Plaintiff, through her counsel, filed a Complaint and a Request to Proceed In Forma Pauperis. (ECF Nos. 1, 4.) The Complaint seeks judicial review of a final decision denying disability benefits by the Commissioner of Social Security. (ECF No. 1.)

The Complaint alleges that Plaintiff's address is in “San Rafael CA 94903, in Los Angeles County, California.” (ECF No. 1 at 1.) San Rafael, however, is in Marin County, which falls within the jurisdictional limits of the United States District Court for the Northern District of California. See 28 U.S.C. § 84(a).

Because it is not clear that venue is proper, the Court ORDERS Plaintiff's counsel to show cause why venue is proper in the Central District of California. If venue is improper, Plaintiff's counsel may request that this action be transferred.

A Response to this Order to Show Cause is due within ten (10) days of the date of this order. The failure to respond to this Order may result in dismissal of this action.

It is so ordered.
