On order of the court, the application for leave to appeal having been held in abeyance pending the decision inBrown v. Department of Transportation (On Reh) (Docket No. 106359), and the appeal in that case having been dismissed by stipulation of the parties in an order dated March 3, 1999, the application is again considered, and it is DENIED because we are not persuaded that the question presented should be reviewed by this Court.

Taylor and Corrigan, JJ., not participating.
