ORDER


This case is before the Court sua sponte.

Plaintiff filed a Complaint in this action on April 29, 2009, pursuant to 42 U.S.C. § 405(g) seeking judicial review of Defendant Commissioner's decision denying her application for Social Security Disability Benefits. (Doc. 2). On June 26, 2009, the Commissioner filed his Answer and a certified copy of the administrative transcript. (Doc. 5). Subsequently, the parties briefed the issues, (Doc. 10, 12, 13), and the matter became ripe for Report and Recommendations.

This Court's initial review of the certified copy of the administrative transcript which the Commissioner filed with this Court reveals that the certification page bears the correct identifying information; that is, Plaintiff Patricia Durrell's name and case number. However, the entire transcript, including the medical records, bears the name of and/or refers to one "Brett Lillard".

Therefore, not later than April 30, 2010, the Commissioner shall file and serve the proper administrative transcript; that is, the transcript that is associated with the administrative proceedings related to Plaintiff Patricia Durrell.

IT IS SO ORDERED.
