By order of November 5, 1999, this case was remanded to the Court of Appeals for further explanation. The Court of Appeals having responded by order of December 16, 1999, the application for leave to appeal from the September 15, 1998 decision of the Court of Appeals is again considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND the case to the Court of Appeals. On remand, we DIRECT the Court of Appeals to treat plaintiff's claim of appeal as an application for leave to appeal and we further DIRECT that court to then grant plaintiff's application for leave to appeal.
