Dubetsky v. 42nd Street, Manhattan & St. Nicholas Avenue Railway Co.

Appellate Division of the Supreme Court of New York, Second Department
Mar 8, 1943
266 App. Div. 671 (N.Y. App. Div. 1943)

Opinion

March 8, 1943.

Appeal from an order conditioning the respondent's substitution as attorney upon the payment of $200, and the retention of a fifty per cent lien for services rendered.

Order, insofar as appealed from, affirmed, with ten dollars costs and disbursements. The record fails to show that the respondent acted without sufficient justification in refusing to prosecute the appeal. Carswell, Johnston, Adel, Taylor and Lewis, JJ., concur.
