On September 19, 2023, after court reporter Thomas Mullins informed the Court that appellant had not requested the reporter's record, we directed appellant by letter to file written verification he had requested the record. Appellant responded by filing proof of payment for the clerk's record. Although our September 19 letter cautioned appellant that the appeal could be submitted without the reporter's record if he failed to comply within ten days, see TEX. R. APP. P. 37.3(c), we EXTEND the deadline. Appellant's verification that he has requested Mr. Mullins to prepare the reporter's record shall be filed no later than October 16, 2023.
We again caution appellant that failure to comply may result in the appeal being submitted without the reporter's record. See id.
