D&R USA Enterprise, Inc.'s v. SCF RC Funding IV, LLC

270th District Court of Harris County, Trial court case number: 2021 -51843A

ORDER

Richard Hightower Judge

On May 31, 2023, appellee SCF RC Funding IV, LLC, filed a motion to supplement the clerk's record with three documents. This motion was directed to the trial court and not to this Court. Because it was filed in this Court, the clerk's office filed it as a motion to supplement the clerk's record.

Rule 34.5(c) permits any party to "direct the trial court clerk to prepare, certify, and filed in the appellate court a supplement containing the omitted item." Tex.R.App.P. 34.5(c). Thus, to the extent appellee intended to ask this Court to supplement the clerk's record, the motion is denied. Appellee may contact the trial court clerk to request supplementation of the clerk's record. See id.

It is so ORDERED.
