Doyle Group v. Scherer

District Court of Appeal of Florida, Fifth District
Feb 11, 2000
750 So. 2d 770 (Fla. Dist. Ct. App. 2000)

Opinion

No. 5D99-2322.

Opinion Filed February 11, 2000.

Non-Final Appeal from the Circuit Court for St. Johns County, Richard G. Weinberg, Judge.

Jay A. Gayoso, of Homer, Bonner Delgado, P.A., Miami, for Appellant.

Dennis K. Bayer, Flagler Beach, for Appellee.

Appellant, Doyle Group, d/b/a Chiropractic Economics ["Doyle"], seeks review of an order denying a temporary injunction to enforce a non-compete agreement. Although we agree that the more logical interpretation of the non-compete agreement is Doyle's, it was within the purview of the lower court to determine that the language is not without doubt and that a temporary injunction should not be entered.

AFFIRMED.

SHARP, W., and THOMPSON, JJ., concur.
