Appeal, No. 178, Jan. T., 1948, from decree of Superior Court, Oct. T., 1947, No. 185, from decree of Orphans' Court, Philadelphia Co., Jan. T., 1908, No. 115, in Estate of Richard H. Downing, deceased. Decree affirmed.

Same case below: 162 Pa. Superior Court 354; 57 Pa. D. C. 656.

Audit of account of trustee. Before HUNTER, J.

Adjudication filed refusing to surcharge trustee for loss on investment; exceptions to adjudication sustained and final decree entered surcharging trustee in part, before VAN DUSEN, P. J., SINKLER, KLEIN, LADNER and HUNTER, JJ., opinion by KLEIN, J. Trustee appealed to the Superior Court, which affirmed the decree of the court below. Appeal by trustee to Supreme Court allowed.

This Decree is affirmed on the opinion of President Judge RHODES of the Superior Court. Costs to be paid by appellant.
