ORDER
BONNIE LEE GOLDSTEIN, JUSTICE.
Before the Court is appellees' November 28, 2023 motion to dismiss the appeal because the appellate record had not been filed and was overdue. Appellants filed a response to the motion stating they have paid the fee for the clerk's record and that the court reporter has not told them the cost for the reporter's record. The clerk's record was filed on December 8, 2023. We DENY the motion.
By postcard notice dated October 20, 2023, the Court notified Official Court Reporter Janet Wright that the reporter's record was overdue and directed her to file the record within thirty days. To date, the reporter's record has not been filed and Ms. Wright has not otherwise communicated with the Court. Accordingly, on the Court's own motion, we ORDER Ms. Wright to file the reporter's record on or before January 10, 2024.
We DIRECT the Clerk of this Court to send a copy of this order to the Honorable Sally Montgomery, Presiding Judge of County Court at Law No. 3; Ms. Wright; and, all parties.
