MEMORANDUM OPINION


By letters dated December 27, 2004 and January 13, 2004, the Court advised appellant that his brief was overdue. The letters directed appellant to file his brief and a motion for extension of time to file his brief within ten days of the date of the letters. The letters warned appellant that failure to comply would result in dismissal of this appeal. To date, appellant has not filed his brief or motion for extension of time to file his brief. Accordingly, the Court DISMISSES this appeal. Tex.R.App.P. 42.3.
