The reporter's record in this case is overdue. The record was originally due December 18, 2022. On December 19, 2022, Kimberly Xavier, Court Reporter for Criminal District Court No. 3, filed a request for an extension of time of forty-five days to file the reporter's record. On December 20, 2022, we granted the request in part, directing that the reporter's record be filed within thirty days, that is, by January 19, 2023. See Tex. R. App. P. 35.3(c) (extensions of time to file reporter's record "must not exceed 30 days in an ordinary or restricted appeal"). On January 19, 2023, we notified Ms. Xavier that the reporter's record was overdue, and we directed her to file the record within thirty days, that is, by February 18, 2023. As of the date of this order, the reporter's record has not been filed, and Ms. Xavier has not communicated with the Court concerning the reporter's record for this appeal since December 19, 2022.

We ORDER Kimberly Xavier, Court Reporter for Criminal District Court No. 3, to file the reporter's record on or before MARCH 15, 2023. If the reporter's record is not filed by March 15, 2023, the Court may abate the appeal for the trial court to determine why the reporter's record has not been filed.
