District Court of Appeal of Florida, Fourth District
Jan 5, 1990
553 So. 2d 288 (Fla. Dist. Ct. App. 1990)

Opinion

No. 88-1394.

November 29, 1989. Rehearing Denied January 5, 1990.

Appeal from the Circuit Court for Broward County; Gene Fischer, Judge.

Mark N. Hirsch and Mark R. McCollem of Chidnese McCollem, Fort Lauderdale, for appellant.

Mary Ann Phillips of Green Murphy, P.A., Fort Lauderdale, for appellee.

REVERSED. Upon review of the record we find the evidence insufficient to sustain the jury's finding that the appellant unreasonably refused to submit to an independent medical examination under section 627.736(7), Florida Statutes (1987). We remand with directions that judgment be entered in favor of appellant.

ANSTEAD, POLEN and GARRETT, JJ., concur.
