Proceedings: (In Chambers) Order Dismissing Case for Failure to Prosecute

On April 3, 2015, we dismissed Plaintiff Lilian Dominguez's (" Plaintiff") First Amended Complaint (" FAC") without prejudice, granting her thirty days to file a Second Amended Complaint (" SAC"). (Dkt. 47.) We warned Plaintiff that the failure to file an SAC would be deemed an admission that amendment is futile and that, in that event, this action would be dismissed with prejudice in its entirety. More than thirty days have passed and no SAC has been filed. Accordingly, Plaintiff's failure to file an SAC is hereby deemed an admission that amendment of her FAC is futile. This action is DISMISSED with prejudice.
IT IS SO ORDERED.
JUDGMENT
Pursuant to the Court's May 13, 2015 Order, IT IS HEREBY ADJUDGED that Plaintiff's First Amended Complaint (" FAC") is DISMISSED with prejudice. Plaintiff shall take nothing by this FAC.
