It is ordered that plaintiff-appellant's motion, deemed one for reargument, is granted to the extent that the decision and order of this Court entered on February 27, 2024 (Appeal No. 1025 is recalled and vacated and a new decision and order substituted therefor (See Appeal No. 1025 decided simultaneously herewith (Motion No. 2024-01520);
And it is further ordered that defendant-respondent Cal Tan, LLC's motion is denied (Motion No. 2024-01748).
