Upon an appeal by permission, order of the Appellate Term of the Supreme Court for the Second and Eleventh Judicial Districts affirmed, with costs (Hutzler v Hertz Corp., 47 A.D.2d 839). Martuscello, Acting P.J., Latham, Cohalan and Christ, JJ., concur; Munder, J., concurs in the result, upon the constraint of Hutzler v Hertz Corp. ( 47 A.D.2d 839), but adheres to the views expressed in the dissenting memorandum in that case. [ 70 Misc.2d 1087. ]
