CLARK EDWARD DIXON, Appellant v. STATE OF TEXAS, Appellee

On Appeal from the 95th Judicial District Court Dallas County, Texas
Trial Court Cause No. DC-17-16892-D

ORDER

Before the Court is appellant's July 13, 2018 motion for extension of time to file his brief, along with his "petition in error with brief in support." The "petition in error with brief in support" is a duplicate of a brief filed June 6, 2018. However, it does not include a copy of the exhibits referenced in the brief.

The June 6th brief was timely filed. Accordingly, it is the operative brief and we DENY the extension motion as moot.

We note appellant's brief fails to comply with the briefing rules in that it does not include a list of all parties to the trial court's judgment, a table of contents, or citations to the record. See TEX. R. APP. P. 38.1(a),(b),(d),(g), (i). Accordingly, we ORDER appellant to file, no later than August 6, 2018, an amended brief that complies with the rules. We caution appellant that failure to comply may result in dismissal of the appeal without further notice. See TEX. R. APP. P. 38.9, 42.3(c).

On our own motion, we DIRECT the Clerk of the Court to send a copy of the clerk's record to appellant.
