ORDER


On December 9, 2003, the parties failed to attend the scheduled case management conference. On December 11, 2003, therefore, the court issued to plaintiff an order to show cause why the case should not be dismissed for failure to prosecute pursuant to FRCP 41(b). Doc # 6. Plaintiff's response to the court's order was due no later than 30 days from the date of that order. The court advised plaintiff that failure to respond to the order would result in dismissal of the action.

As of January 14, 2004, the court has received no response from plaintiff. Accordingly, in keeping with its December 11, 2003, order, the court ORDERS that plaintiff's claims be

DISMISSED without prejudice for failure to prosecute pursuant to FRCP 41(b). The clerk is directed to close the file and terminate all pending motions.

IT IS SO ORDERED.
